These Terms & Conditions ("Terms") govern your access to and use of the Avyukta Intellicall website, WhatsApp Business Platform solutions, RCS messaging services and Avyukta Intellicall CRM (together, the "Services"). By accessing our website or using our Services, you agree to be bound by these Terms.
2. Description of Services
Avyukta Intellicall provides business messaging and customer engagement solutions, including WhatsApp Business Platform integration, RCS messaging, automation, analytics and a CRM platform for managing customer conversations. Features, pricing and availability of Services may be updated from time to time.
3. Eligibility and Account Responsibility
You must be authorised to act on behalf of the business you represent when requesting a demo, signing up for, or using our Services. You are responsible for maintaining the confidentiality of any account credentials and for all activity under your account.
4. Acceptable Use
You agree not to use the Services to send unsolicited, unlawful, deceptive or spam messages, to violate WhatsApp's or any messaging partner's commerce and business policies, or to engage in any activity that is illegal, infringing or harmful to others. Avyukta Intellicall may suspend or terminate access for violations of this section.
5. Fees and Payment
Paid plans are billed according to the pricing and billing cycle communicated at the time of subscription, as also described on our Pricing page. All fees are exclusive of applicable taxes unless stated otherwise. Payments are processed through our authorised payment gateway partners.
6. Third-Party Platforms
Our Services rely on third-party platforms such as WhatsApp Business Platform (operated by Meta Platforms, Inc.) and RCS messaging infrastructure. Your use of these channels is also subject to the relevant third party's own terms and policies, and Avyukta Intellicall is not responsible for changes, outages or restrictions imposed by such third parties.
7. Intellectual Property
All content, trademarks, logos and software associated with Avyukta Intellicall and this website are the property of Avyukta Intellicall or its licensors. You may not copy, modify, distribute or reverse-engineer any part of the Services without our prior written consent.
8. Confidentiality
Each party agrees to protect the other's confidential information disclosed during the course of the engagement and to use it only for purposes related to the Services.
9. Limitation of Liability
To the maximum extent permitted by law, Avyukta Intellicall shall not be liable for any indirect, incidental, special or consequential damages arising from your use of, or inability to use, the Services, including loss of messages, delivery delays caused by third-party platforms, or business interruption.
10. Termination
Either party may terminate the Services in accordance with the agreed subscription terms. Avyukta Intellicall may suspend or terminate access immediately in cases of suspected misuse, non-payment, or violation of these Terms.
11. Governing Law
These Terms are governed by the laws of India, and any disputes shall be subject to the exclusive jurisdiction of the courts at Jaipur, Rajasthan.
12. Changes to These Terms
We may revise these Terms from time to time. Continued use of the Services after changes are posted constitutes acceptance of the revised Terms.
